1. OUR COMMITMENT
1.1. Hireinst ("we", "us", "our") is committed to fair, equal-opportunity hiring in the hospitality sector. We want Workers to be judged on their skills, experience, and suitability for the role — not on personal characteristics unrelated to the job.
1.2. This Policy sets the standard we expect of every Restaurant / Employer that uses the Platform, and of every User. It is part of our Terms of Service and works alongside the Employer (Restaurant) Terms, Community Guidelines, and Acceptable Use Policy. Capitalised terms not defined here have the meaning given in the Terms of Service.
2. SCOPE
2.1. This Policy applies to all hiring-related activity on the Platform, including job postings, search and screening, messaging, interview practices recorded on the Platform, ratings and notes, and offers.
2.2. Restaurants make their own hiring decisions, and Hireinst is a platform/intermediary, not the employer. This Policy governs how Restaurants may use the Platform: we prohibit using Hireinst to discriminate unlawfully or contrary to this Policy, and we act against Users who do.
3. PROTECTED CHARACTERISTICS
3.1. Restaurants must not discriminate against Workers or applicants on the basis of characteristics unrelated to genuine job requirements, including:
- religion, race, caste, or community;
- sex, gender, gender identity, or transgender status;
- sexual orientation;
- place of birth, descent, or ethnicity;
- disability;
- health status, including HIV/AIDS status;
- marital status, pregnancy, or maternity;
- language; and
- any other characteristic protected under Applicable Law.
3.2. This standard reflects the spirit of equality under the Constitution of India and specific protections under Indian law, including the Rights of Persons with Disabilities Act, 2016, the HIV and AIDS (Prevention and Control) Act, 2017, the Transgender Persons (Protection of Rights) Act, 2019, and the equal-remuneration principle under the Code on Wages, 2019 / Equal Remuneration framework.
4. PROHIBITED DISCRIMINATORY PRACTICES
4.1. On the Platform, Restaurants must not:
(a) publish job posts that state or imply a preference, limitation, or exclusion based on a protected characteristic (for example, "only [religion/caste/gender] candidates"), except where a genuine and lawful occupational requirement applies (see Clause 5); (b) reject, screen out, or refuse to consider applicants because of a protected characteristic unrelated to the job; (c) offer different wages or terms for the same or similar work on the basis of gender or another protected characteristic, contrary to the equal-remuneration principle; (d) harass, demean, or make derogatory remarks about a Worker on the basis of a protected characteristic; or (e) record discriminatory notes, ratings, or reasons.
4.2. Discriminatory job postings and conduct also violate the Acceptable Use Policy and Community Guidelines.
5. GENUINE AND LAWFUL OCCUPATIONAL REQUIREMENTS
5.1. Certain roles may have genuine, lawful requirements that relate to the job itself — for example, a specific skill, certification, physical capability essential to the role, or a lawful role-specific requirement. Stating and applying such genuine requirements is not discrimination.
5.2. Any such requirement must be genuinely necessary for the role and lawful. It must not be used as a pretext to exclude people on the basis of a protected characteristic. If in doubt, Restaurants should frame requirements around the actual tasks and competencies of the role.
6. INCLUSIVE HIRING (ENCOURAGED)
6.1. We encourage Restaurants to:
- write inclusive, role-focused job posts;
- consider applicants on merit and job-fit;
- make reasonable accommodations for persons with disabilities where practicable, consistent with the Rights of Persons with Disabilities Act, 2016; and
- maintain respectful, professional communication with all applicants.
7. IF YOU EXPERIENCE DISCRIMINATION
7.1. If you are a Worker and you believe a Restaurant has discriminated against you or posted a discriminatory job on the Platform, you can:
- report the job post, profile, or conversation using the in-app tools; or
- email support@hireinst.com; or
- raise a formal grievance with our Grievance Officer, Tallam Sai Kiran, at legal@hireinst.com.
7.2. We review such reports under the Content Moderation Policy and Grievance Redressal Policy, and may remove content and take action against the Restaurant.
7.3. This Policy governs use of the Platform. For statutory remedies relating to employment discrimination, you may also have rights before the appropriate authorities or courts under Applicable Law.
8. OUR ENFORCEMENT
8.1. Where a Restaurant uses the Platform to discriminate contrary to this Policy, we may: remove the offending job post or content; issue a warning; restrict features; suspend; or terminate the Account — in accordance with the Content Moderation Policy. Serious or repeated violations may result in permanent removal.
9. LIMITATIONS
9.1. Hireinst is a platform/intermediary and does not control, and is not responsible for, hiring decisions or offline conduct by Restaurants. We cannot guarantee the conduct of any User. This Policy sets our standards for use of the Platform and our enforcement of them; it does not make Hireinst a party to any hiring or employment.
10. CHANGES
10.1. We may update this Policy from time to time. The "Last Updated" date reflects the current version.
