1. PURPOSE

1.1. This Disclaimer & Limitation of Liability consolidates important disclaimers about Hireinst ("we", "us", "our") and the limits of our liability. It restates and supplements the disclaimers and liability provisions in our Terms of Service and applies to all use of the Services. If there is any inconsistency, the Terms of Service prevail. Capitalised terms not defined here have the meaning given in the Terms of Service.

2. WE ARE A PLATFORM / INTERMEDIARY ONLY

2.1. Hireinst is a technology platform and intermediary that helps hospitality Workers and Restaurants in India discover one another and communicate. We are not an employer, recruiter, staffing or placement agency, or agent of any User, and we are not a party to any job, application, offer, negotiation, engagement, or contract of employment between a Worker and a Restaurant.

2.2. All hiring decisions and all terms of any engagement (including wages, hours, duties, benefits, workplace conditions, and termination) are made solely and directly between the Worker and the Restaurant, independently of Hireinst.

3. NO GUARANTEE OF OUTCOMES

4. "AS IS" AND "AS AVAILABLE"

4.1. The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by Applicable Law, including implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement.

4.2. We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or free of viruses or harmful components, or that defects will be corrected.

5. USER CONTENT AND VERIFICATION

5.1. Most content on the Platform is provided by Users. We do not author, endorse, or guarantee the accuracy, completeness, legality, or reliability of any User content, including profiles, resumes, restaurant listings, logos, job posts, ratings, and messages.

5.2. Verification is a limited signal, not a guarantee. We are not a background-verification, criminal-record, credit-check, or reference-check agency. Any Verification we perform confirms only limited facts and does not replace your own due diligence. You are responsible for independently verifying any User, job, or information before relying on it.

6. USER INTERACTIONS AND OFFLINE CONDUCT

6.1. You are solely responsible for your interactions with other Users, whether online or offline. We are not responsible for, and disclaim all liability arising from:

7. THIRD-PARTY SERVICES AND LINKS

7.1. The Services rely on and may link to third-party services (including authentication, messaging, payment, storage, and analytics providers). We do not control and are not responsible for third-party services, their content, or their acts or omissions. Your use of them may be subject to their own terms and privacy policies.

8. NO PROFESSIONAL ADVICE

8.1. Information provided on or through the Services is for general purposes only and does not constitute legal, financial, tax, employment, or other professional advice. You should obtain your own professional advice before making decisions.

9. LIMITATION OF LIABILITY

9.1. To the maximum extent permitted by Applicable Law, The Hiring Planet and its partners, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, business, opportunity, wages, or employment, arising out of or relating to your use of (or inability to use) the Services, even if advised of the possibility of such damages.

To the maximum extent permitted by Applicable Law, our total aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the total fees actually paid by you to us in the 3 (three) months immediately preceding the event giving rise to the claim, or (b) INR 1,000 (Indian Rupees One Thousand).

10. EXCEPTIONS

10.1. Nothing in this document excludes or limits any liability that cannot lawfully be excluded or limited under Applicable Law, including liability for fraud, or for death or personal injury caused by our proven negligence. Nothing here affects the statutory rights of consumers under the Consumer Protection Act, 2019.

11. INDEMNITY

11.1. As set out more fully in the Terms of Service and role-specific terms, you agree to indemnify and hold harmless The Hiring Planet and its partners, employees, and agents from claims, losses, and expenses arising out of your use or misuse of the Services, your content, your breach of the Terms, or your violation of Applicable Law or third-party rights.

12. GOVERNING LAW AND JURISDICTION

12.1. This document is governed by the laws of India and is subject to the dispute-resolution and jurisdiction provisions of the Terms of Service (arbitration seated at, and courts of, Hyderabad, Telangana).
