EMPLOYER (RESTAURANT) TERMS

HOW THIS DOCUMENT WORKS

These Employer (Restaurant) Terms ("Employer Terms") apply to you if you access or use Hireinst as a restaurant operator or hospitality establishment (an "Employer", "Restaurant", "you", "your") to discover, contact, and hire hospitality workers ("Workers").

These Employer Terms supplement the Terms of Service and all policies incorporated by it (including the Privacy Policy, Acceptable Use Policy, Community Guidelines, Verification Policy, Content Moderation Policy, Subscription & Billing Terms, Anti-Discrimination / Equal Opportunity Hiring Policy, and Grievance Redressal Policy). You must comply with all of them.

In case of conflict between these Employer Terms and the Terms of Service in relation to the Employer role, these Employer Terms prevail for that role. Capitalised terms not defined here have the meaning given in the Terms of Service.

By registering as, or using the Platform as, an Employer, you agree to these Employer Terms.


1. ELIGIBILITY AND AUTHORITY

1.1. You must be at least 18 years of age and competent to contract.

1.2. If you use the Platform on behalf of a restaurant, business, firm, or company, you represent and warrant that you are duly authorised to bind that entity to these Employer Terms, and "you" refers to both you and that entity. You are responsible for the acts and omissions of any person who uses the Platform under your Account or on your behalf.

1.3. You represent and warrant that the restaurant is a genuine, lawfully operating establishment and that you have the right to advertise the jobs you post.


2. RESTAURANT LISTING: CLAIM OR CREATE

2.1. Claiming a listing. The Platform may contain pre-listed restaurants. You may claim a listing that corresponds to a restaurant you are authorised to represent. A claim is subject to verification (including OTP verification) and review and approval by our team before it takes effect. Submitting a claim does not guarantee approval.

2.2. Creating a listing. Where no listing exists, you may create one, providing accurate and complete information.

2.3. Accuracy. You must ensure that all restaurant information (name, address, contact details, description, images, and logo) is true, accurate, current, lawful, and not misleading. You must promptly update it if it changes.

2.4. False or unauthorised claims. Claiming a restaurant you are not authorised to represent, or providing false claim information, is a serious breach of these Employer Terms and may be reported to law-enforcement authorities. We may reject, suspend, or revoke a claim at our reasonable discretion, including on the basis of reports, flags, or suspected misuse.


3. VERIFICATION AND KYC

3.1. As part of claim or account verification, we may require identity or authority documents. Where we collect an Aadhaar card and/or PAN card or comparable identity document, we retain it for a maximum of 30 (thirty) days and delete it once verification is complete or 30 days elapse, whichever is earlier, as described in the Verification Policy and Privacy Policy.

3.2. Verification is a signal, not an endorsement, guarantee, or approval, and does not transfer any responsibility for hiring or employment to Hireinst.


4. JOB POSTINGS

4.1. Genuine, lawful jobs only. You may post only genuine vacancies for lawful hospitality roles that you are authorised to fill. Each posting must accurately describe the role, location, responsibilities, and requirements.

4.2. Prohibited postings. You must not post any job or content that:

(a) is fake, misleading, speculative, or a "recruitment scheme" that is not a genuine vacancy; (b) requires a Worker to pay any fee, deposit, "registration", training, uniform, or other charge to Hireinst or to you as a condition of applying, being interviewed, or being hired, in a fraudulent or exploitative manner; (c) discriminates against applicants on any ground prohibited by Applicable Law or by our Anti-Discrimination / Equal Opportunity Hiring Policy (including on the basis of religion, caste, sex, gender, place of birth, disability, or other protected characteristics), except where a genuine and lawful occupational requirement applies; (d) is for work that is illegal, unsafe, hazardous without lawful safeguards, or contrary to labour or other laws; (e) offers wages below any applicable statutory minimum wage; (f) involves any form of forced labour, bonded labour, child labour, or trafficking; (g) collects Workers' personal data for purposes unrelated to genuine hiring; (h) is otherwise contrary to the Acceptable Use Policy, Community Guidelines, or Applicable Law.

4.3. Wage and role transparency. You must not misrepresent wages, hours, benefits, or the nature of the role. Where you state wages, they must be genuine.


5. YOU ARE THE EMPLOYER — HIREINST IS NOT

5.1. Independent hiring. Any decision to interview, select, engage, employ, or reject a Worker, and all terms of any employment or engagement (including wages, hours, duties, benefits, and termination), are made solely by you, independently of Hireinst. Hireinst is a platform/intermediary only and is not the employer, co-employer, recruiter, or staffing agency, and is not a party to any employment or engagement.

5.2. Your statutory responsibilities. As the employer/engager, you are solely responsible for complying with all Applicable Law relating to employment and engagement of the Workers you hire, including (as applicable) laws on minimum wages, payment of wages, working hours, provident fund, employees' state insurance, gratuity, contract labour, occupational safety and workplace conditions, and prevention of sexual harassment at the workplace (including obligations under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, where applicable). Hireinst bears no responsibility for these.

5.3. Due diligence. You are solely responsible for verifying the identity, eligibility, qualifications, documents, references, and background of any Worker before engaging them. Any Verification signals provided by Hireinst do not replace your own checks.

5.4. Employment disputes. Any dispute arising out of an engagement (including non-payment of wages, workplace safety, misconduct, or termination) is solely between you and the Worker. Hireinst is not responsible for, and will not adjudicate, such disputes.


6. MESSAGING AND CONTACTING WORKERS

6.1. You initiate contact. Initial contact through the Platform's messaging feature is initiated by Restaurants. You must use messaging only for genuine, respectful, hiring-related communication.

6.2. Prohibited use. You must not use messaging or contact details to harass, threaten, defraud, spam, solicit money unlawfully, make unwanted advances, discriminate, or contact a Worker who has indicated they do not wish to be contacted.

6.3. Contact reveal. Where the Platform allows you to reveal a Worker's contact details (which may be a paid, entitlement-gated feature), you may use those details only for the legitimate purpose of the specific hiring for which they were revealed. You must not sell, share, publish, or use them for marketing, spam, or any unrelated purpose.


7. DATA PROTECTION OBLIGATIONS OF EMPLOYERS

7.1. When you receive a Worker's personal data through the Platform (for example, through an application, a revealed contact detail, or a resume), you become independently responsible, as a Data Fiduciary in your own right under the Digital Personal Data Protection Act, 2023, for how you handle that personal data.

7.2. You must: use Worker personal data only for genuine hiring purposes; keep it secure; not retain it longer than necessary; not share or sell it unlawfully; and comply with Applicable Law, including honouring Workers' data-protection rights and deleting data on lawful request. You must not use Worker data to build competing databases or for unsolicited marketing.

7.3. You will indemnify Hireinst against any claim arising from your misuse of Worker personal data.


8. RESTAURANT CONTENT, LOGO, AND LICENCE

8.1. You own your content. Restaurant logos, brand marks, images, and descriptions you upload remain owned by you or your licensors. Restaurant logos are and remain the property of the respective restaurant.

8.2. Licence to us. You grant Hireinst a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers) licence to host, store, display, reproduce, and distribute your restaurant content and logo solely to operate, provide, and promote the Services (for example, to display your listing and job postings, including on public and search pages). This licence lasts while your content is on the Platform and ends on deletion, subject to residual backups and content already shared with Users.

8.3. Your warranties. You represent and warrant that you own or have all rights to the content and logo you upload, and that they do not infringe any third party's rights or violate Applicable Law.


9. RATINGS, NOTES, AND REVIEWS

9.1. Any ratings, notes, or reviews you record about applicants must be genuine, lawful, non-defamatory, and used only for legitimate hiring purposes. You must not post fake reviews, misrepresent yourself, or record notes that are discriminatory or unlawful.


10. SUBSCRIPTIONS AND FEES

10.1. Certain Employer features (such as contact reveal, unlimited job postings, interview scheduling, message templates, or priority listing) may require a paid Subscription, governed by the Subscription & Billing Terms. Fees are handled in accordance with those terms and the Refund & Cancellation Policy (which sets a no-refund default with statutory exceptions).

You must not:


12. SUSPENSION AND TERMINATION

12.1. We may suspend or terminate your Account, remove your listings or job postings, or revoke a claim, with or without notice, if you breach these Employer Terms, the Terms of Service, or Applicable Law, or where required to protect Workers, third parties, or us. Enforcement follows the Content Moderation Policy.

12.2. On termination, your right to use Employer features ends. Provisions that by their nature survive (including Clauses 5, 7, 8.2, 13, and dispute-resolution provisions) continue to apply. Data handling on termination follows the Data Retention & Deletion Policy.


13. INDEMNITY (EMPLOYER-SPECIFIC)

13.1. In addition to the indemnity in the Terms of Service, you agree to indemnify, defend, and hold harmless The Hiring Planet and its partners, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) any job posting or restaurant content you provide; (b) your hiring decisions, employment or engagement of any Worker, and compliance (or non-compliance) with employment and labour laws; (c) any employment or workplace dispute between you and a Worker; (d) your misuse of Worker personal data or contact details; or (e) your breach of these Employer Terms or Applicable Law.

Complaints are handled under the Grievance Redressal Policy, with acknowledgement within 24–48 hours and resolution within the timelines required by Applicable Law.


15. GOVERNING LAW AND JURISDICTION

15.1. These Employer Terms are governed by the laws of India, and are subject to the dispute-resolution and jurisdiction provisions of the Terms of Service (arbitration seated at, and courts of, Hyderabad, Telangana).


By using Hireinst as an Employer, you acknowledge that you have read, understood, and agree to these Employer (Restaurant) Terms.
