1. PURPOSE
1.1. Hireinst ("we", "us", "our") respects intellectual-property rights and expects its Users to do the same. This Policy explains who owns what on the Platform, what you must not upload, and how rights holders can report infringing content so that we can act on it.
1.2. This Policy reflects our role as an intermediary under the Information Technology Act, 2000, and our obligations under the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. It is part of our Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service.
2. OWNERSHIP OF INTELLECTUAL PROPERTY
2.1. Our IP. The "Hireinst" name and logo, the Platform software, design, interface, text, graphics, and databases are owned by or licensed to The Hiring Planet and are protected by intellectual-property laws. Except for the limited licence to use the Services in the Terms of Service, no rights are granted to you, and you may not use our marks without our prior written consent.
2.2. Your content. You retain ownership of the content you upload. You grant us only the limited licence needed to operate, provide, and promote the Services, as set out in the Terms of Service and role-specific terms.
2.3. Restaurant logos. Restaurant logos and brand marks uploaded by a Restaurant remain owned by that Restaurant (or its licensors). A Restaurant that uploads a logo represents that it owns or is authorised to use that logo and that it does not infringe any third party's rights.
3. YOU MUST NOT UPLOAD INFRINGING CONTENT
3.1. You must not upload, post, or share any content that infringes another person's copyright, trademark, or other intellectual-property or proprietary rights. This includes using another restaurant's name or logo without authority, copying another User's profile or content, or using images or text you do not have the right to use.
4. REPORTING INFRINGEMENT (NOTICE)
4.1. If you are a rights holder (or authorised to act for one) and you believe content on the Platform infringes your intellectual-property rights, you may send a written notice to us at legal@hireinst.com (subject line: "IP Infringement Notice"), or by post to the address in Clause 9.
4.2. To enable us to act, please include all of the following:
(a) your name, address, email, and phone number, and (if acting on behalf of a rights holder) your authority to act; (b) identification of the work or mark in which you claim rights (for example, the copyrighted work or the registered trademark and its registration number, if any); (c) identification of the allegedly infringing content and its exact location on the Platform (for example, the profile, listing, or URL); (d) a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law; (e) a statement that the information in your notice is accurate; and (f) your signature (physical or electronic).
4.3. Incomplete notices may delay our ability to act. We may ask for further information or supporting documents (for example, proof of trademark registration).
5. WHAT WE DO ON A VALID NOTICE
5.1. On receiving a notice that appears valid, we will review it and, where appropriate, remove or disable access to the allegedly infringing content, and/or take other action under the Content Moderation Policy.
5.2. We will endeavour to act within the timelines in our Grievance Redressal Policy, and within any shorter timeline required by a valid court or government order (which we action within the timelines required by law).
5.3. We may notify the User who posted the content of the action taken and the general reason, and provide them the opportunity to submit a counter-notice (Clause 6).
6. COUNTER-NOTICE
6.1. If your content was removed and you believe this was a mistake or that you have the right to use the content, you may send a counter-notice to legal@hireinst.com including:
(a) your name, address, email, and phone number; (b) identification of the content that was removed and its previous location; (c) a statement, made in good faith, that you believe the content was removed as a result of mistake or misidentification, or that you have the necessary rights; and (d) your signature (physical or electronic).
6.2. We will review the counter-notice. Where appropriate, we may restore the content, unless the matter is subject to a binding legal order or restoration would otherwise be unlawful. Disputes about the underlying rights are between you and the complaining party; we are not the adjudicator of ownership.
7. REPEAT INFRINGERS
7.1. We maintain a policy of taking action against repeat infringers. Where a User repeatedly uploads infringing content, we may suspend or permanently terminate their Account, in addition to removing the content. We may keep records of infringement notices and repeat infringers as required by Applicable Law and to enforce this policy.
8. MISUSE OF THIS PROCESS
8.1. Submitting false, bad-faith, or materially misleading infringement notices or counter-notices is a violation of our Terms and may expose you to liability under Applicable Law. We may reject or disregard notices that are abusive, frivolous, or clearly invalid, and may take action against Users who misuse this process.
9. NO OBLIGATION TO MONITOR; INTERMEDIARY STATUS
9.1. Consistent with our intermediary status, we are not obliged to proactively monitor all content for infringement, and we do not do so. We act on valid notices and orders. Our removal of content does not make us the author or publisher of User content and does not affect our intermediary protections.
10. CHANGES
10.1. We may update this Policy from time to time. The "Last Updated" date reflects the current version.
