HOW THIS DOCUMENT WORKS

These Worker Terms apply to you if you access or use Hireinst as a hospitality job seeker (a "Worker", "you", "your") — for example as a chef, cook, bartender, waiter, captain, steward, helper, or cleaner — to build a profile, discover jobs, apply, and communicate with restaurants ("Employers" or "Restaurants").

These Worker Terms supplement the Terms of Service and all policies incorporated by it (including the Privacy Policy, Acceptable Use Policy, Community Guidelines, Verification Policy, Content Moderation Policy, and Grievance Redressal Policy). You must comply with all of them.

In case of conflict between these Worker Terms and the Terms of Service in relation to the Worker role, these Worker Terms prevail for that role. Capitalised terms not defined here have the meaning given in the Terms of Service.

By registering as, or using the Platform as, a Worker, you agree to these Worker Terms.

1. ELIGIBILITY

1.1. You must be at least 18 (eighteen) years of age and competent to contract under the Indian Contract Act, 1872.

1.2. You represent and warrant that the information you provide about your identity, experience, and qualifications is true and belongs to you, and that you are legally permitted to work in the roles you apply for.

2. YOUR ACCOUNT AND PROFILE

2.1. Accurate profile. You must provide accurate, current, and complete information in your profile, including your genuine name, contact number, skills, and experience. You must not misrepresent your identity, qualifications, or experience.

2.2. Photograph and resume. You may upload a profile photograph and a resume/CV. You must have the right to upload them, and they must relate to you and be lawful, decent, and non-misleading.

2.3. Keep it updated. You are responsible for keeping your profile accurate and up to date.

2.4. Your account is personal. You must not share, sell, or transfer your Account, or let another person use it. You are responsible for activity under your Account and for keeping your credentials secure.

3. VERIFICATION AND KYC

3.1. We may ask you to verify your mobile number by OTP and, in some cases, to provide identity documents for Verification. Where we collect an Aadhaar card and/or PAN card or comparable identity document, we retain it for a maximum of 30 (thirty) days and delete it once Verification is complete or 30 days elapse, whichever is earlier, as described in the Verification Policy and Privacy Policy.

3.2. Verification confirms limited facts and is a safety signal only. It is not a guarantee of a job and does not make Hireinst a party to any hiring.

4. HOW HIRING WORKS ON HIREINST

4.1. We are a platform, not an employer. Hireinst helps you discover Restaurants and jobs and communicate with them. Hireinst is not your employer, agent, or recruiter, does not hire you, and is not a party to any job, offer, or employment. Any job, offer, engagement, and its terms (including wages, hours, and duties) are agreed directly between you and the Restaurant.

4.2. No guarantee of a job. We do not guarantee that you will receive any interview, offer, employment, wage, or income, or that any Restaurant or job posting is genuine, safe, or suitable. You are responsible for your own decisions.

4.3. Who contacts whom. To protect you from unsolicited contact, initial contact through Platform messaging is initiated by Restaurants. You can search and apply to jobs and respond to Restaurants that contact you.

4.4. Your own due diligence. Before accepting any interview, offer, or engagement, you should satisfy yourself that the Restaurant, job, wages, and working conditions are genuine and acceptable to you.

5. WORKER SAFETY — IMPORTANT PROTECTIONS

5.1. Never pay to get a job. A genuine Restaurant will not ask you to pay money to Hireinst or to the Restaurant in order to apply, be interviewed, be "registered", get a uniform, get "training", or be hired as a fraudulent precondition. If anyone asks you to pay money to get a job, treat it as a warning sign and report it to us at support@hireinst.com.

5.2. Protect your personal information. Do not share sensitive personal or financial information (such as bank details, passwords, OTPs, or full identity documents) with a Restaurant before you are satisfied the opportunity is genuine and it is necessary. Hireinst will never ask you for your account password or OTP.

5.3. Report and block. If a Restaurant or any User behaves inappropriately, harasses you, asks for money, makes unwanted advances, or shares unlawful content, you can report and/or block them through the Platform or by contacting us. We review reports and flags and may act under the Content Moderation Policy.

5.4. Meet safely. Where you attend an interview or workplace, take sensible precautions for your personal safety. Hireinst is not responsible for offline interactions, but we take reports seriously.

6. PROFILE VISIBILITY AND YOUR CONSENT

6.1. Visibility to Restaurants. By creating a profile, you understand and agree that your profile information (which may include your photograph, skills, experience, and resume, but excluding certain direct contact details) is visible to Restaurants on the Platform to enable hiring.

6.2. Contact reveal. Your direct contact details are protected and are revealed to a Restaurant only through a controlled, paid "contact reveal" feature, or where you choose to share them. By using the Platform you consent to this mechanism.

6.3. Managing visibility. Where the Platform provides controls over your visibility or profile, you may use them. You may also request deletion of your Account and data as described in the Data Retention & Deletion Policy.

7. YOUR CONTENT AND LICENCE

7.1. You own your content. You retain ownership of the profile information, photograph, and resume you upload.

7.2. Licence to us. Solely to operate, provide, secure, and improve the Services, you grant Hireinst a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers) licence to host, store, display, reproduce, and format your profile content for the purpose of showing it to Restaurants and running the marketplace. This licence lasts while your content is on the Platform and ends on deletion, subject to residual backups and content already shared (for example, an application already sent to a Restaurant).

7.3. Your warranties. You represent and warrant that your content is truthful, belongs to you or you have the right to use it, and does not infringe any third party's rights or violate Applicable Law.

9.1. You are responsible for your own tax and statutory obligations arising from any employment or engagement you obtain. Any wages, benefits, and statutory entitlements are matters between you and the Restaurant that engages you, and are governed by Applicable Law and your arrangement with that Restaurant.

10. YOUR DATA AND RIGHTS

10.1. Our handling of your personal data is governed by the Privacy Policy and Data Retention & Deletion Policy, which explain what we collect, how we use it, how long we keep it, and your rights (including access, correction, erasure, nomination, grievance, and withdrawal of consent). KYC documents follow the 30-day deletion rule in Clause 3.

11. RATINGS AND FEEDBACK

11.1. Where the Platform allows you to rate or review a Restaurant or an interaction, your feedback must be genuine, based on real experience, lawful, and non-defamatory. You must not post fake, incentivised, or malicious reviews.

12. SUSPENSION AND TERMINATION

12.1. By you. You may stop using the Services and request deletion of your Account at any time.

12.2. By us. We may suspend or terminate your Account, or remove your content, with or without notice, if you breach these Worker Terms, the Terms of Service, or Applicable Law, or to protect other Users, third parties, or us. Enforcement follows the Content Moderation Policy.

12.3. Provisions that by their nature survive (including Clauses 4, 7.2, and dispute-resolution provisions) continue after termination. Data handling on termination follows the Data Retention & Deletion Policy.

13. DISCLAIMERS AND LIABILITY

13.1. The disclaimers and limitations of liability in the Terms of Service apply to your use of the Services as a Worker. In particular, Hireinst is not responsible for the conduct of any Restaurant, the genuineness or safety of any job, the payment of any wages, or any offline interaction.

14. GRIEVANCES AND REPORTING

14.1. To report a problem, a scam, harassment, or a policy violation, contact us at support@hireinst.com or use the in-Platform reporting tools. For formal grievances:

14.2. Complaints are handled under the Grievance Redressal Policy, with acknowledgement within 24–48 hours and resolution within the timelines required by Applicable Law.

15. GOVERNING LAW AND JURISDICTION

15.1. These Worker Terms are governed by the laws of India and are subject to the dispute-resolution and jurisdiction provisions of the Terms of Service (arbitration seated at, and courts of, Hyderabad, Telangana). Nothing in these Worker Terms limits any right you may have under the Consumer Protection Act, 2019 or other Applicable Law.

By using Hireinst as a Worker, you acknowledge that you have read, understood, and agree to these Worker Terms.
